Indictment Filed on Suspicion of Engaging in Intelligence Activities
On 13 August 2025, the Federal Public Prosecutor’s Office filed an indictment against
US-American national Martin D.
before the State Security Chamber of the Koblenz Higher Regional Court.
There are sufficient grounds to suspect the accused of one particularly serious count of declaring his willingness to a foreign intelligence service to engage in intelligence activities (section 99 para. 1 no. 2, para. 2 of the German Criminal Code [StGB] in conjunction with section 1 para. 1 no. 4 of the Act on the Protection of NATO Troops [NTSG]).
The indictment essentially sets out the following allegations:
Between 2017 and spring 2023, Martin D. worked for a civilian contractor for the U.S. Department of Defense. By 2020 the latest, he was stationed at a U.S. military base in Germany. In the summer of 2024, the accused repeatedly contacted Chinese state agencies and offered to pass on sensitive U.S. military information to a Chinese intelligence service.
The accused has been in pre-trial detention since 7 November 2024 in execution of an arrest warrant issued by the Investigating Judge at the Federal Court of Justice (see Press Release No. 64 of 7 November 2024).
